The Takoma Park Silver Spring Co-op has been granted a temporary injunction by Circuit Court Judge Harry Storm in its lawsuit against the Neighborhood Development Company, the organization announced.
The injunction will allow the co-op to continue to use the parking lot at Takoma Junction leased by NDC from the city and in turn subleased to the co-op for deliveries.
NDC sent a letter to co-op management on April 15, citing safety concerns over deliveries by 18-wheeled trucks, that served as notice of 30-day termination of the co-op’s sublease.
The co-op then filed a lawsuit on the grounds that the letter violated the terms of a 2018 cooperation agreement between the two parties that outlined how the co-op could operate pre-, post- and during construction of a proposed NDC redevelopment at Takoma Junction on Carroll Avenue.
The injunction will allow the co-op to continue receiving deliveries until a trial on the suit is held.
